Supreme Court to consider Obama immigration action

If the Court strikes down these executive actions, the fate of many of the nation’s unauthorized immigrants will fall to the next president.

The suspense over when the Supreme Court will hear the challenge to President Obama’s executive actions relating to deferred deportation for certain unauthorized immigrants now shifts to suspense over what the Court’s decision will be. The Supreme Court will take up the case during this term, and is expected to yield a decision by June.

The plaintiffs make the case that the Administration did not follow proper notice-and-comment administrative procedure in establishing the “deferred action for parents of Americans” program and expanding its “deferred action for childhood arrivals.” However, the courts have a history of some deference to the executive branch’s discretion, so it’s really a coin toss how the Court will rule.
